Terms and Conditions

These Terms and Conditions govern your access to and use of JingleGift, a service for purchasing, sending, accepting, downloading, and setting ringtone gifts. By using JingleGift, creating an account, buying a gift, accepting a gift, or opting into SMS messages, you agree to these Terms.
1. About JingleGift
JingleGift lets a buyer purchase a ringtone gift for a recipient. The recipient may receive a gift invitation, sign in with their mobile phone number, accept the gift, download the ringtone, and follow setup instructions for their device.
JingleGift is designed for personal gifting between people who know each other. It is not intended for unsolicited marketing, bulk messaging, harassment, or contacting people who would not reasonably expect a gift invitation from you.
2. Eligibility and Accounts
You must be old enough to form a binding contract in your jurisdiction, or use JingleGift with permission from a parent or legal guardian. Accounts use mobile phone numbers for sign-in.
JingleGift supports international phone numbers, but some messaging, delivery, setup, payment, and support features may vary by country, carrier, device, and local rules.
You are responsible for providing accurate phone numbers, keeping control of your device and phone number, and telling us if you believe your account or phone number has been used without authorization.
3. Buyer Responsibilities
When you send a JingleGift, you must provide your own mobile number, the recipient mobile number, and any optional message truthfully. You may not send gifts to people for abusive, deceptive, illegal, or unwanted purposes.
JingleGift will send a gift SMS to the recipient only if that recipient already has an active JingleGift account, has opted into JingleGift SMS messages, and is in a country where automatic SMS delivery is supported. If the recipient is not eligible for automatic JingleGift SMS, you are responsible for sharing the gift link from your own messaging app or another personal channel.
We may block, cancel, or refund gifts that appear abusive, fraudulent, spam-like, or non-compliant.
4. Recipient Gifts and Device Setup
Recipients must sign in with the same phone number used by the buyer to receive the gift. A recipient owns access to their gifted ringtone copy through their JingleGift account, subject to these Terms and the license terms for the ringtone.
After a successful checkout, JingleGift may create a pending recipient account record for the recipient phone number so the gift is waiting when that recipient verifies the same phone number.
Android may support guided ringtone setup with device permissions. iOS setup depends on Apple platform capabilities and the recipient device version. JingleGift may provide instructions, downloads, or guided setup, but cannot guarantee that every device, carrier, operating system, or contact app will support every ringtone setup option.
5. SMS Messaging Terms
JingleGift uses SMS and similar messaging to support phone-number sign-in, gift invitations, gift status updates, ringtone setup, installed confirmations, account notices, support, and related service messages.
By providing your phone number and opting into the JingleGift transactional text messaging program, you consent to receive text messages from JingleGift at the mobile number you provide. Messages may include one-time login codes, gift alerts, account and setup notifications, installed confirmations, and support messages. Message frequency varies by account and gift activity. Standard message and data rates may apply. For assistance, reply HELP to the number from which you received the message, or contact support@jinglegift.com. To stop receiving messages, reply STOP at any time. Carriers are not liable for delayed or undelivered messages.
Because JingleGift accounts use mobile phone numbers, SMS verification is required to create or sign in to a JingleGift account. If you opt out of SMS, you may be unable to receive sign-in codes, accept gifts by SMS, receive automatic gift alerts, or use other phone-number-based account features until you opt back in.
- Gift invitations: JingleGift sends recipient gift SMS messages only to phone numbers tied to active JingleGift accounts that are opted into SMS and located in supported automatic SMS delivery countries.
- Buyer-shared links: if the recipient has not opted into JingleGift SMS or automatic SMS delivery is not supported for the recipient country, the buyer receives suggested message text and a gift link to send from the buyer’s own messaging app.
- Opt-out: replying STOP may prevent you from receiving further SMS messages from JingleGift, including messages needed to sign in or accept gifts by SMS.
- Help: replying HELP provides assistance information when supported by the messaging channel.
6. Payments, Prices, and Refunds
Prices are shown before checkout and may vary by ringtone, promotion, territory, taxes, fees, and availability. Payments are processed by Stripe or another payment provider; JingleGift does not store full credit card numbers.
Ringtone gifts are digital goods. Refunds, cancellations, recipient-number corrections, duplicate charges, failed delivery, rights issues, or suspected fraud are handled through JingleGift support. We may cancel and resend a gift to a corrected recipient number where appropriate.
7. Ringtone License
Unless otherwise stated, a purchased or gifted ringtone gives the recipient a personal, limited, non-transferable, non-commercial license to download and use that ringtone as a ringtone or alert tone on their own devices.
You may not copy, resell, redistribute, upload, sample, remix, publicly perform, or otherwise exploit JingleGift ringtones except as expressly allowed by JingleGift. Catalog previews may contain watermarks and may not be used as purchased ringtone files.
8. Content and Conduct
Gift messages must not be unlawful, threatening, harassing, hateful, sexually exploitative, deceptive, invasive of privacy, infringing, or otherwise harmful. We may remove messages, block accounts, or contact support when we detect abuse.
Creators or bands who submit content must own or control the necessary rights and provide accurate contact, ownership, and licensing information. Creator marketplace and revenue-share terms may be governed by separate written agreements.
9. Intellectual Property
JingleGift, the JingleGift name, branding, site design, software, catalog presentation, and related materials are owned by JingleGift or its licensors. Ringtones, artwork, and audio assets are owned by JingleGift, creators, licensors, or other rights holders.
Nothing in these Terms transfers ownership of JingleGift software, branding, or catalog content to you.
10. Availability and Changes
JingleGift is an evolving service and may change over time. We may add, remove, retire, or modify ringtones, features, setup flows, prices, and supported countries or platforms.
If a ringtone is removed from sale, recipients who already received that ringtone will generally continue to have access to their owned gift copy where technically and legally possible.
11. Disclaimers and Limitation of Liability
JingleGift is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted service, successful SMS delivery, device compatibility, ringtone setup success, or that every recipient will accept or install a gift.
To the maximum extent permitted by law, JingleGift will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, revenues, data, goodwill, or business opportunities.
12. Governing Law and Updates
These Terms are governed by the laws of the State of California and applicable United States federal law, without regard to conflict-of-law principles, unless local consumer law requires otherwise.
We may update these Terms as the service develops. The updated version will be posted on this page with a new effective date. Continued use of JingleGift after changes become effective means you accept the updated Terms.
