Privacy Policy

This Privacy Policy explains how JingleGift collects, uses, discloses, and protects personal information when you use our ringtone gifting service, website, mobile experience, SMS flows, checkout, support, and creator inquiry features.
1. Information We Collect
- Account and contact information, such as mobile phone number, display name if provided, locale, and support contact details.
- Gift information, such as buyer phone number, recipient phone number, gift message, selected ringtone, gift status, acceptance status, setup status, and installed confirmation.
- Payment and checkout information processed by Stripe, such as transaction identifiers, checkout status, price, taxes, and limited payment metadata. We do not store full card numbers.
- SMS consent and messaging information, such as consent text, consent version, opt-in context, timestamp, phone number, HELP/STOP interactions where available, delivery status, and audit records.
- Catalog and creator information, such as band inquiry contact details, sample audio, rights attestations, licensing notes, and creator communications.
- Technical information, such as IP address, device type, browser, operating system, log data, cookies, analytics identifiers, and general usage activity.
2. How We Use Information
- Provide, operate, secure, and improve JingleGift.
- Send phone verification codes and support phone-number sign-in.
- Process purchases, create gift orders, send gift invitations, and track delivery, acceptance, setup, and installed confirmation.
- Provide ringtone downloads, setup guidance, and support.
- Maintain ringtone licensing, rights, catalog, creator, and revenue-share workflows.
- Detect, prevent, and respond to fraud, spam, abuse, security incidents, legal claims, and policy violations.
- Comply with law, carrier rules, messaging-provider requirements, payment-provider requirements, and audit requests.
3. SMS Privacy and Mobile Number Sharing
JingleGift uses mobile numbers to provide the service. We may send SMS messages for login codes, gift invitations, account notifications, setup instructions, installed confirmations, support, and related transactional purposes.
We do not sell or rent mobile phone numbers. We do not share mobile phone numbers, SMS opt-in data, or SMS consent records with third parties or affiliates for their own marketing or promotional purposes. Mobile opt-in and consent data is used only to provide, secure, support, and document the JingleGift messaging program. We may share mobile numbers and SMS-related information with service providers that help us operate JingleGift, such as messaging providers, hosting providers, fraud-prevention providers, analytics providers, payment processors, and support tools, only as needed to provide and protect the service.
4. Gift Link Delivery
A buyer may provide a recipient phone number to create and address a ringtone gift. JingleGift uses that number to determine whether the recipient already has an active account with SMS opt-in and to make the gift available when the recipient signs in with that same phone number.
When checkout succeeds, JingleGift may store the recipient phone number as a pending account record and associate the gift with that account. The recipient must verify that phone number before viewing, accepting, downloading, or setting up the gift.
JingleGift supports international phone numbers, but automatic SMS delivery is available only in supported countries and may depend on carrier, sender registration, local law, and messaging-provider availability.
If the recipient has not opted into JingleGift SMS, or automatic SMS delivery is not supported for the recipient country, JingleGift does not send the first gift invitation text. Instead, the buyer receives suggested message text and a gift link that the buyer can send from the buyer’s own messaging app or another personal channel.
5. How We Share Information
- With service providers, including Twilio for messaging, Stripe for payments, Vercel for hosting, Neon for database hosting, Cloudflare R2 for media storage, and other vendors used to operate the service.
- Between buyers and recipients as needed for the gift experience. For example, a recipient may see the buyer name or phone number because the ringtone is intended to be associated with calls from that buyer.
- With creators, licensors, or rights holders when needed to manage catalog content, rights, royalties, disputes, or takedown requests.
- For legal, safety, compliance, and protection purposes, including responding to lawful requests, enforcing our Terms, preventing abuse, and protecting users or the service.
- In connection with a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar business transaction, subject to appropriate protections.
6. Cookies and Analytics
We may use cookies, local storage, analytics tools, and similar technologies to keep the service working, understand usage, improve performance, measure conversion, prevent fraud, and remember preferences.
If we use advertising, retargeting, or cross-context behavioral advertising in the future, we will update this Privacy Policy and provide any legally required choices.
7. Data Retention
We keep personal information for as long as reasonably necessary to provide JingleGift, maintain gifted ringtone access, comply with legal and accounting obligations, resolve disputes, enforce agreements, support messaging audits, and protect the service.
Recipients will generally continue to have access to gifted ringtone copies tied to their phone number, even if a ringtone is later retired from the public catalog, subject to legal and technical limits.
8. Security
We use administrative, technical, and organizational safeguards designed to protect personal information. No online service, messaging channel, or storage system can be guaranteed to be completely secure.
9. International Users
JingleGift is intended to be globally available. Personal information may be processed in the United States and other countries where we or our service providers operate. These countries may have data protection laws different from those in your jurisdiction.
10. Your Choices and Rights
- You may reply STOP to supported SMS messages to opt out of further texts from that number.
- You may reply HELP to supported SMS messages for help information.
- You may contact support@jinglegift.com to request access, correction, deletion, portability, objection, restriction, or other privacy rights available under applicable law.
- If you lose access to a phone number, contact support so we can review account recovery options.
11. Children
JingleGift is not intended for children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child provided personal information, contact us so we can review and take appropriate action.
12. Changes to This Policy
We may update this Privacy Policy as JingleGift changes. The updated version will be posted on this page with a new effective date.
